By placing an order in this site the customer agrees to the following terms and conditions. The customer is authorizing the company to purchase the required gift in his name and on his behalf and take all the necessary steps to hand-over the gift to the receiving party. While rendering the service the company is acting only as an authorized representative of the client and not as his agent or in any other capacity. The company shall be handling the material only as a service provider and its liability shall be restricted to that of a bailey under the contract Act.

Definitions:

vasamflorists.com: The company providing the delivery service. Customer / Client: The person using the delivery service and ordering the gifts for the recipient. Gifts: Products ordered by the customer to be delivered.

Perishable gift:

All gifts in the Fresh Flowers, Gourmet sections and items containing above products in the combo section and gift baskets section.

Non-Perishable gifts: All Other gifts except perishable gifts.

Products:

The gifts delivered to the recipient will be generally as per the description of the article and as per the picture chosen by the customer. But may vary in appearance and colors especially in the perishable goods at the delivery destination. The non-perishable articles may also have variations as many are hand made. The customer agrees to the variations and understands the nature of the variations and allows vasamflorists.com to deliver a product, which may be similar to the product picture exhibited on this web-site. Flowers specified in the arrangements shown may differ as per the seasonal availability. In case of non availability of the flower variety specified in the arrangements at the delivery destination, suitable alternatives will be used at the discretion of this site which will be taken as the authorization the customer gives us on placing the order.

Payments:

All prices are in Indian Rupees and US Dollars. Payments will be accepted in Indian Rupees as well as US Dollars and charged to the credit card/ debit card/ charge card or bank account in specified currency.

vasamflorists.com accepts Visa and MasterCard and also accepts payments through net banking as per the payment gateway integration. The credit card information never comes to us. We just get the payment receipt information only.

Non Delivery & Non Availability:

If the ordered product/s is out of stock,A complete refund will be made to the customer if he wishes so. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc caused due to the non-delivery and non-availability.

Delivery Attempt:

For each order only one attempt will be made to deliver the gifts.

If vasamflorists.com or their vendors could not successfully deliver the gifts due to the reasons 1. wrong, improper or partial address given of the recipient or 2. not providing correct telephone no. of the recipient or 3. the receiver not in that address or not in the premises at the time of the delivery attempt or 4. the receiver refuse to receive the gifts on any grounds or 5. the door of the premises locked, the order will be treated as executed and no claim shall be entertained for the refund of the amount paid towards the order.

All efforts Will be taken to deliver the product to the recipient personally or as per his/her request to the neighbour. A The recipient will be able to collect the gift/s from our vendor office that will be mentioned on the delivery note within 24 hours from the date of delivery, if he happen to be not in the address at the time of the delivery attempt.A Beyond that the order will be treated as executed despite non delivery.

Delivery Period and Timing:

vasamflorists.com shall try to deliver the gift on the 'preferred date'. Please allow the minimum time required for delivery as specified in each category. Gift deliveries shall be made within three to seven working days in India provided the time specified for that category of gifts is not more. Delivery shall be made on the 'preferred day', or a day earlier or later if it coincides with a festival day or a national/regional holiday. Delivery shall be made in the course of the day, and the customer agrees to refrain from requesting for deliveries at very early or late hours of the day. All attempts will be made to deliver at the specified time on the preferred date of delivery but Gifts Nice.com will not be responsible if the gifts cannot be delivered at the specified time due to unavoidable circumstances.

Cancellations:

Once a gift is ordered the customer cannot cancel it. The reason being that the system immediately processes the order and sends shipping instructions. Due to the high volume of transactions it becomes difficult to cancel the orders.

In case we receive a cancellation notice and the order has not been processed by us, we shall cancel the order without any cancellation charge.

On cancellation of an order after it has been processed by vasamflorists.com and not yet delivered, the cancellation charges will be 50% of the order value:

Once a delivery attempt is made, no cancellation will be accepted and no refunds will be made.

Warranty:

Perishable Gifts - No warranty to any kind of goods Non-perishable Gifts - Warranties are provided by the suppliers of the gifts in certain items. The customer agrees that the customer service issues regarding the products (gifts) will be taken up with the manufacturer directly. vasamflorists.com will pass on any warranty cards if available to the recipient of the gift at the time of delivery.

Disputes:

All disputes related to "vasamflorists.com" service shall be subject to the jurisdiction of Chennai ( India ) courts only.
